How will the new EU rules on artificial intelligence change everything?

The European Union has recently passed the AI Act, a legislative framework designed to regulate the development and use of artificial intelligence (AI) within the EU territory. This legislation represents an ambitious attempt to balance technological innovation with the protection of the fundamental rights of European citizens.

The AI Act aims to classify AI systems based on the risks they pose to people's health, safety, and fundamental rights. The goal is to create an environment where AI can responsibly thrive while simultaneously strengthening citizens' trust in these new technologies.

However, like many regulations attempting to govern rapidly developing technologies, the AI Act has "some ambiguities" that require careful examination. Similar to the Digital Services Act (DSA) and Digital Markets Act (DMA), the regulation uses terms that are "open to interpretation" and does not always provide precise metrics for risk assessment.

For example, the regulation refers to "negative impacts on health, safety, and fundamental rights" without offering clear quantitative definitions of what constitutes such impacts. This lack of specific criteria could create uncertainties for developers and AI system providers, making it difficult to determine whether their products fall into the "high-risk" category.

Moreover, the risk assessment process, a key element of the regulation, relies largely on qualitative evaluations. While this approach offers flexibility in a rapidly evolving sector, it can also lead to differing interpretations among EU member states.

These aspects of the regulation warrant thorough analysis by all parties involved: developers, businesses, policymakers, and citizens. It is essential to strike a balance between the need to protect citizens' rights and the promotion of innovation in a sector that is vital for Europe's economic and technological future.
